eFax Sweepstakes Giveaway Official Rules 1. NO PURCHASE NECESSARY. PURCHASE WILL NOT ENHANCE CHANCES OF WINNING. 2. ELIGIBILITY: The eFax Sweepstakes (the "Sweepstakes"), brought to you by j2 Global Communications, Inc. (the "Sponsor"), is governed by these Official Rules. To enter, you must be a legal resident of the 50 United States or Washington D.C. and 18 years of age or older at the start of the Sweepstakes entry period. All entries become the exclusive property of Sponsor. Void where prohibited. Sponsor reserves the right, at any time, to verify eligibility requirements, in any manner it deems appropriate. 3. THE SWEEPSTAKES ENTRY PERIOD: The Sweepstakes begins 12:00:01 AM Pacific Standard Time on October 8, 2008 and concludes 11:59:59 PM Pacific Standard Time December 1, 2008 ("Sweepstakes Entry Period"). Sponsor's computer is the official time keeping device for the Sweepstakes. 4. TO ENTER: Entrants will be invited to complete a eFax survey (herein referred to as "Survey"). The survey includes an entry form requiring the entrant's first name or first initial, entrant's last name, entrant's company (if applicable) and entrant's phone number. The entrant may also provide an optional testimonial. Incomplete entries will be disqualified. 5. OPTIONAL TESTIMONIAL REQUIREMENTS. BY SUBMITTING A TESTIMONIAL, ENTRANT ACKNOWLEDGES THAT HIS/HER TESTIMONIAL MAY BE POSTED ON SPONSOR'S WEBSITE, OR USED FOR ANY REASON IN SPONSOR'S DISCRETION. By entering, you acknowledge that Sponsor has no obligation to use or post any Testimonial you submit. Submission of a Testimonial grants Sponsor and its agents an unlimited, worldwide, perpetual, license and right to publish, use, publicly display the Testimonial in any way, in any and all media, without limitation, and without consideration to the entrant. By submitting a Testimonial you warrant and represent that it: (a) is your original work, (b) has not been previously published, (c) has not won previous awards, (d) does not infringe upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property or other rights of any person or entity; (e) that you have obtained permission from a person who's name or likeness is used in the Testimonial; (f) that accurately reflects your opinion, and the statements made are known to be true and are based on personal familiarity with your use of eFax; and (g) and that publication of the Testimonial via various media including Web posting, will not infringe on the rights any third party rights. Any such entrant will indemnify and hold harmless, Sponsor from any claims to the contrary. 6. WINNER: One (1) winner will be randomly selected from among all completed survey entries in a random drawing to be conducted on December 1, 2008, under the supervision of Sponsor. The odds of winning depend on the number of eligible entries received. 7. PRIZE DETAILS/ODDS: One (1) Apple iPod Shuffle. (ARV $50). Winner must accept prize as specified by Sponsor and on dates designated by Sponsor, or prize will be forfeited. Prize cannot be assigned, transferred, redeemed for cash, or substituted except by Sponsor who may, at its sole discretion, substitute any prize with one of comparable value if the advertised prize becomes unavailable for any reason. 8. CONDITIONS OF PARTICIPATION: Participants agree (a) to these Official Rules and the decisions of Sponsor which are final and binding, (b) that Sponsor, its parent, subsidiary and affiliated companies, advertising and promotion agencies, and all of their officers, directors, employees, representatives and agents will have no liability whatsoever for, are released and shall be held harmless by participants against any liability for any injuries, losses or damages of any kind to persons, including death, or property resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize or participation in this Sweepstakes or Sweepstakes-related activities or use of the Testimonial and (c) except where legally prohibited, winner grants (and agree to confirm that grant in writing) permission to Sponsor and those acting under Sponsor's authority the right to the use of his/her name, company name, Testimonial, likeness, voice, image and biographical information and statements and the Testimonial for advertising, trade, publicity and promotional purposes without additional compensation, in all media now known or hereafter discovered, worldwide and on the Internet and World Wide Web, without notice, review or approval. 9. REQUIRED DOCUMENTATION: Winner will be notified via mail. Winner may be required to complete, sign, and return an Affidavit of Eligibility, a Liability Release and, where lawful, a Publicity Release within seven (7) days after notification. If documents are not returned on a timely basis, or if any prize notification or prize is returned as non-deliverable, or if winner is found to be ineligible or not in compliance with these Official Rules, such prize will be forfeited. Should a prize be won by a minor, all affidavits, releases and other documents must be executed by the parent or legal guardian of the minor, on behalf of himself and the minor, or prize may be forfeited. Prize may be awarded in the name of, or to, minor winner's parent or legal guardian. Taxes on a prize are solely the responsibility of the winner. 10. GENERAL PROVISIONS: Neither Sponsor nor its agencies are responsible for not receiving entries, no matter what the reason even if known in advance, or other errors of any kind whether human, mechanical, electronic or network or the incorrect or inaccurate capture of entry or the failure to capture any such information. Persons who tamper with any aspect of the Sweepstakes, as solely determined by the Sponsor, or who attempt to participate with multiple email addresses or under multiple identities will be disqualified. Any use of robotic, automatic, macro, programmed or like entry methods will void all such entries and disqualify any entrant using such methods. Should any portion of the Sweepstakes be, in Sponsor's sole opinion, compromised by virus, worms, bugs, non-authorized human intervention, technical failures or other causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness or proper play, or submission of entries, Sponsor reserves the right at its sole discretion to suspend, modify or terminate the Sweepstakes. In case of dispute, the authorized subscriber of the email account used to enter the Sweepstakes at the actual time of entry will be deemed to be the participant, and must comply with these Official Rules. 11. GOVERNING LAW AND ARBITRATION: This Sweepstakes will be governed by and interpreted under the laws of the State of California, without application of any conflicts of law rules. Disputes between the parties or their affiliates related to this Sweepstakes shall be submitted to final, binding arbitration heard by a single arbitrator in accordance with the then-current Commercial Arbitration Rules of the American Arbitration Association (except as modified herein). Any counterclaim not brought within thirty (30) days after receipt of the arbitration notice shall be barred. The arbitration shall be conducted in Los Angeles County, California in English. Unless otherwise specified herein, the arbitrator may award any relief that he deems proper, including but not limited to equitable relief. The award shall be final and binding and enforceable in any court of competent jurisdiction. 12.
